Negligent Security Cases in South Carolina

Negligent security cases fall under premises liability law in South Carolina. These cases arise when property owners fail to provide adequate security measures to protect visitors from foreseeable criminal acts. Property owners, including apartment complexes, have a legal duty to ensure the safety of their guests and tenants.

Elements of a Negligent Security Claim

To establish a negligent security claim in South Carolina, the plaintiff must prove:

  1. The property owner owed a duty of care to the victim
  2. The property owner breached that duty by failing to provide adequate security
  3. The breach of duty directly led to the victim's injuries or death
  4. The victim suffered damages as a result

What are Reasonable Security Measures?

For apartment complexes and similar properties, reasonable security measures may include:

  • Proper lighting in parking lots and common areas
  • Functioning security cameras
  • Functioning entry/exit gates
  • Secure locks on doors and windows
  • Regular security assessments
  • Trained security personnel, if warranted by the property's history or location

The Importance of Foreseeability

Foreseeability of criminal activity is crucial in negligent security cases. If an apartment complex or the surrounding area has a history of violent crimes, the property owner might be expected to implement more stringent security measures. This could include additional lighting, security patrols, or controlled access systems.
