How Can a Motel Be Held Liable When a Guest is Shot?

Motel owners have a duty to provide safe and clean rooms to guests. Not every shooting at a motel will serve as the basis for a viable negligent security or wrongful death claim. The reality is that some shootings can’t be prevented.

A negligent security case is a type of premises liability claim. Premises liability typically looks to whether a landowner or business took reasonable steps to remedy or fix hazardous conditions. In a negligent security case involving a shooting at a motel, we’re asking the same question: Did the motel take reasonable steps to deter foreseeable violent attacks on the motel premises? If not, then the motel may be liable.

What Types of Attacks Typically Occur at Motels in South Carolina?

Negligent security cases involving incidents at motels will generally involve one of the following types of criminal attacks:

  • Homicide;
  • Shooting;
  • Stabbing;
  • Armed robbery;
  • Sexual assault or rape; or
  • Some other violent criminal act.

The above list of criminal acts is not exhaustive, and any violent criminal attack at a motel may be the subject of a negligent security claim if the motel owner, property owner, or any other potential defendant acted negligently. Thus, if you or a loved one have been the victim of a criminal attack at a motel, regardless of whether the specific type of attack is listed above, you may have a viable a claim for negligent security.
