Can You Bring a Lawsuit on Behalf of a Loved One That Was Shot and Killed at a Hotel in Florida?

If a loved one has been shot and killed at a hotel in Florida, the surviving family members may be able to bring a wrongful death lawsuit against the responsible parties under the theory of negligent security. In Florida, a wrongful death claim is typically brought by the personal representative of the deceased person's estate on behalf of the surviving family members.

The personal representative can be named in the deceased person's will, or if there is no will, a court can appoint one. In general, the personal representative must act in the best interests of the surviving family members and may be able to recover damages on their behalf, such as compensation for medical expenses, funeral costs, and loss of financial support

To establish a wrongful death claim in Florida, the surviving family members may need to prove that the hotel owner or operator was negligent and that this negligence caused or contributed to the death of their loved one. They may also need to show that the deceased person's death resulted in financial losses or other damages to the surviving family members.

If you have lost a loved one in a shooting at a hotel in Florida, it is recommended to consult with a qualified attorney who can provide specific legal advice based on your situation.
