On Thursday, January 19, 2023, a 72-year-old woman was killed when a Denny’s sign fell onto a vehicle in the Denny’s parking lot in Elizabethtown, Kentucky. Sources say that there were high winds, upwards of 50 miles per hour, when the sign came down.

There were 3 passengers in the vehicle, two in the front and one in the back. The pictures of the incident indicate that passenger in the back, 72-year-old Lillian Curtis, took a direct impact from the sign. Her cause of death was listed as “blunt force injuries.” The other two passengers, her daughter and husband, suffered non-life-threatening injuries.

Premises Liability at Restaurants

If you’ve been in an accident at a restaurant or in a restaurant parking lot, the restaurant may be liable for your medical bills, pain and suffering, lost wages, and more. This type of claim is commonly known as a premises liability claim, which includes accidents such as slip and falls and trip and falls. Essentially, a premises liability claim arises when a restaurant owner or property owner fails to maintain a property in a reasonably safe condition, and then someone gets hurt as a result. Thus, when a visitor to a restaurant, store, or other establishment is injured as a result of an unreasonably dangerous condition, the visitor may have a viable personal injury claim.
